This Warranty Policy explains the additional warranty provided by CTB Performance and Accessories Limited for eligible CTB performance packages and modifications.
1. About the CTB Warranty
CTB Performance and Accessories Limited ("CTB", "we", "us" or "our") provides this warranty for eligible performance packages and modifications supplied by CTB.
The CTB Warranty is an additional warranty covering the CTB performance upgrade and certain related vehicle components as described below.
This warranty is separate from the vehicle manufacturer's new-car warranty. CTB does not administer or determine claims made under the manufacturer's warranty.
Nothing in this warranty excludes or limits any rights or remedies that cannot lawfully be excluded under New Zealand law, including applicable rights under the Consumer Guarantees Act 1993.
2. Eligible Vehicles
The CTB Warranty is available for vehicles that have an applicable manufacturer's new-car warranty remaining at the time the eligible CTB performance package is installed.
This includes used vehicles that still have applicable new-car warranty remaining when the CTB package is installed.
The CTB Warranty does not restart or extend the vehicle's original new-car warranty period.
Any package-specific eligibility requirements will be advised before installation.
3. Warranty Period
Unless CTB expressly agrees otherwise in writing for a particular package, the CTB Warranty begins when the eligible CTB performance package is installed and continues for the remainder of the vehicle's applicable new-car warranty period.
For example, if a CTB package is installed on a vehicle that has two years of its applicable new-car warranty remaining, the CTB Warranty will ordinarily apply for that remaining two-year period.
The applicable expiry date will therefore depend on the vehicle's original warranty commencement date, mileage limits and the terms of the manufacturer's applicable new-car warranty.
Any different warranty period expressly stated in the documentation for a particular CTB package takes priority over this general provision.
4. What the CTB Warranty Covers
Subject to this policy and any package-specific warranty terms, the CTB Warranty covers:
- CTB-supplied performance components included in the eligible package; and
- factory vehicle components where CTB determines that a failure was caused by the CTB performance upgrade.
Where a covered failure is confirmed, CTB will determine an appropriate remedy, which may include repair or replacement of the affected component.
CTB may inspect the vehicle, review diagnostic information and investigate the cause of a failure before accepting a warranty claim.
Normal manufacturer warranty matters that are unrelated to the CTB performance upgrade should continue to be handled through the appropriate manufacturer or dealer warranty process.
5. Servicing, Maintenance and Fuel
The vehicle must be serviced and maintained in accordance with the applicable Ford or vehicle manufacturer's servicing and maintenance requirements.
The customer is responsible for ensuring required servicing is completed and for retaining appropriate service records.
Petrol vehicles covered by a CTB performance calibration must use fuel with a minimum rating of 95 RON, unless CTB specifies a higher minimum fuel grade for the particular package or calibration.
The vehicle must also be operated in accordance with any specific instructions supplied by CTB for the installed performance package.
A failure to comply with a servicing, maintenance or fuel requirement will not automatically be treated as the cause of an unrelated failure. CTB may consider whether the failure to comply caused or contributed to the claimed problem.
6. Further Modifications
The CTB Warranty is provided on the basis of the vehicle specification approved by CTB.
If the vehicle is subsequently performance-modified, tuned or mechanically modified by another workshop or person without CTB's written approval, the additional CTB Warranty will become void from the date of that modification.
This includes changes to engine or transmission calibrations and other performance modifications that alter the CTB-approved vehicle specification.
Further modifications carried out by CTB will be assessed individually. Depending on the modification, the existing CTB Warranty may:
- remain unchanged;
- continue with specific conditions or exclusions; or
- no longer apply.
CTB will advise the customer of any effect on the existing CTB Warranty before the additional CTB modification is authorised.
This section concerns the additional contractual warranty offered by CTB. It does not exclude any statutory rights or remedies that cannot lawfully be excluded.
7. What Is Not Covered
Unless CTB has expressly agreed otherwise in writing, the CTB Warranty does not cover a failure or damage caused or contributed to by:
- accident, collision or external damage;
- misuse, abuse or negligent operation;
- insufficient or incorrect servicing or maintenance;
- fuel below the required minimum grade or contaminated or incorrect fuel;
- unauthorised tuning or modification;
- operation contrary to CTB or manufacturer instructions;
- competition or motorsport use;
- timed events;
- drag racing;
- drifting;
- deliberate sustained abuse or similar competitive vehicle use; or
- continued operation after a fault or warning where doing so causes additional damage.
Normal wear and maintenance items are not covered merely because they require replacement during the warranty period.
Competition or motorsport use may only be covered where CTB has expressly approved that use in writing.
Nothing in these exclusions limits rights or remedies that cannot lawfully be excluded.
8. Diagnosis
If a customer believes a vehicle has developed a problem covered by the CTB Warranty, CTB must be given a reasonable opportunity to inspect and diagnose the vehicle.
Where diagnosis confirms a failure covered by the CTB Warranty, CTB will cover the reasonable diagnostic costs associated with establishing that covered failure.
Where investigation establishes that the problem is not covered by the CTB Warranty, the customer may be responsible for reasonable diagnostic costs.
CTB will explain any proposed charge where reasonably practicable before substantial non-warranty diagnostic work is undertaken.
9. Making a Warranty Claim
If a potential warranty issue occurs, stop using the vehicle where continued operation could cause further damage or create a safety risk.
Contact CTB Performance & Accessories or the Ford dealer that supplied the CTB-equipped vehicle as soon as reasonably practicable.
Provide the vehicle registration or VIN, current mileage, details of the problem and any relevant warning messages or fault information.
CTB will then arrange or approve the appropriate diagnostic process.
Repairs must not be carried out by another repairer without CTB's prior approval where it is reasonably practicable to obtain that approval.
In an emergency where prior approval cannot reasonably be obtained, the customer should take reasonable steps to prevent further damage and contact CTB as soon as possible. Keep invoices, diagnostic information and evidence of the circumstances.
Warranty claims and authorisations are handled by email or other written electronic communication.
10. Warranty Repairs
Where CTB accepts a claim under the CTB Warranty, CTB will arrange the repair through CTB or an approved repairer.
CTB may use new, remanufactured or otherwise suitable replacement components where appropriate, provided the repair restores the vehicle or component to the standard required under this warranty and applicable law.
CTB is not responsible under this additional warranty for unauthorised repair costs where CTB was reasonably available to assess and arrange the repair, subject always to rights the customer may have under applicable law.
11. Transfer of Vehicle
The CTB Warranty relates to the eligible CTB-equipped vehicle rather than only to its original owner.
If the vehicle is sold during the applicable warranty period, the remaining CTB Warranty may continue with the vehicle provided:
- the vehicle remains eligible;
- the warranty has not previously become void under these terms;
- servicing and maintenance requirements have been met; and
- the vehicle remains in the CTB-approved specification.
The new owner should contact CTB so our warranty records can be updated.
12. Your Consumer Rights
The CTB Warranty provides contractual protection in addition to rights that may apply under New Zealand law.
The Consumer Guarantees Act 1993 provides guarantees relating to goods and services supplied to consumers, including acceptable quality of goods and reasonable care and skill in providing services. Those rights can apply independently of an additional warranty and are not necessarily limited to the stated warranty period.
The Consumer Guarantees Act may not apply in some business transactions, including where businesses have lawfully contracted out of it in writing and the statutory requirements for doing so are satisfied.
Nothing in this CTB Warranty excludes or limits a right or remedy that cannot lawfully be excluded.
